In an era of accelerated technological advancement, a multitude of technologies such as Big Data, Blockchain, Artificial Intelligence, etc. have emerged, making it impossible for any jurisdictions to anticipate the potential evolution of technology and to constantly revise and update the legal framework for electronic transactions at the national level.
As one of the leading entities in conducting in-depth research on electronic transactions law, Asia Legal noticed that Vietnam has profoundly adopted and inherited from the “technology-neutrality” approach in drafting the Law on E-Transaction Law 2023. Based on the assumption that such an approach will promote statutory longevity and create equal treatment of old and new technologies, legislators may then concentrate on regulating other aspects such as integrity, trustworthiness, non-repudiation, etc. in electronic transactions.
However, the ‘technology-neutrality’ approach has also resulted in considerable obstacles for many organizations and individuals when practicing electronic transaction laws. In some instances, even tax authorities do not recognize electronic contracts during tax audits and inspections. In our opinion, the root cause of these obstacles lies in insufficient awareness of technology, the history of electronic media formation, and the structure of electronic media development, including computer science and cryptography.
With the aim of introducing a new approach to electronic transactions law, on October 6, 2023, the Vietnam Business Lawyers Club (VBLC) will host the Seminar on “Law on Electronic Transactions” – an event that will gather many lawyers, experts in the field of business and commerce, as well as the participation of representatives from the Ministry of Industry and Trade and the Ministry of Justice.
In this seminar, Asia Legal’s representative – Mr. Luu Vinh will present the new points of the Electronic Transactions Law 2023 compared to the Electronic Transactions Law 2005 and the impact of the Electronic Transactions Law 2023 on the business activities of enterprises in Vietnam.
