RESOLVING DISPUTES THROUGH DOCUMENT- ONLY ARBITRATION – INTERNATIONAL PRACTICE AND RECOMMENDATION FOR VIETNAM 

Asia Legal is pleased to introduce an article written by Mr. Luu Xuan Vinh (Richard Luu) – Managing Partner, titled “Resolving Disputes through Document-Only Arbitration – International Practice and Recommendation for Vietnam.” This article was originally published in the Vietnam Lawyer Journal. 

The article offers a comprehensive analysis of Document-Only Arbitration (DOA), a form of arbitration where disputes are resolved based entirely on written submissions, without oral hearings. It examines the legal basis for DOA in international frameworks such as the UNCITRAL Model Law, arbitration rules of institutions like ICC, LCIA, SIAC, and the national laws of Singapore, the UK, France, China, among others. 

From a Vietnamese perspective, Mr. Vinh evaluates the implicit legal foundation of DOA under the Law on Commercial Arbitration 2010 and the VIAC Rules, and puts forward clear, practical recommendations for incorporating DOA explicitly into Vietnam’s legal system. These proposals aim to help Vietnam align with global best practices and enhance the efficiency of its dispute resolution mechanisms, particularly relevant to low-value or less complex commercial disputes in today’s fast-paced digital economy.
