Despite sharing some basic principles with the EU General Data Protection Regulation (“GDPR“) on the purpose limitation, data minimization and accountability, the Vietnam Draft Law on personal data protection (“Draft Law“) has a narrower scope, less clarity on profiling, and uncertainty about de-identification of personal data. These differences highlight the need for further refinement to align with international standards and ensure effective data protection once enacted. In this second Article, Asia Legal will compare the Draft Law with the GDPR, highlight the progress of the Draft Law in enhancing privacy protections but also address its limitations compared to the GDPR.
