On the morning of October 24, 2026, Lawyer Luu Xuan Vinh, Managing Partner of Asia Legal, participated in a discussion session on “Legal Risk Management in Business” with participants of the fifth cohort of the Executive Master of Business Administration (EMBA5) program at Thuongmai University. This approach provided an opportunity to examine legal issues in the context of practical management and business decision-making. Beyond identifying relevant legal provisions, the discussion focused on how businesses can apply these provisions to address specific situations, mitigate risks, and manage their operations more proactively.
From Addressing Emerging Issues to Proactive Risk Prevention
Legal risk management is becoming increasingly important for businesses as their operations are subject to a broad range of legal requirements, while management decisions may give rise to significant legal consequences.
Addressing legal issues only after they arise is not sufficient to safeguard business operations. Businesses need to progressively integrate risk identification and assessment into business planning, contract negotiation and performance, operational management, and decision-making processes.
Growing interest in this area also reflects a shift in how businesses approach legal matters: moving away from focusing primarily on resolving issues after they arise toward proactively preventing and managing legal risks before and throughout the course of business activities.
Through the discussion with EMBA5 participants, practical legal issues arising from business operations served as a basis for exchanging experience and examining the role of legal risk management in executive decision-making. This approach also helps bridge legal knowledge with the practical demands of business management and decision-making.
